Welcome to moneymagnet.ai ("the Platform," "we," "us," or "our"), operated by

Mag. Martin Parkos, Hietzinger Hauptstrasse 113, Top 1-3, 1130 Wien, Austria.

By accessing or using our website, CRM infrastructure, and AI-based communication tools (collectively, "the Services"), you agree to be bound by these Terms of Service ("Terms").

1. Scope and Software Reselling Disclosure

These Terms govern the contractual relationship between moneymagnet.ai and its business clients (B2B only). We do not offer services to consumers (B2C).

moneymagnet.ai provides white-labeled access to cloud-based CRM and AI software infrastructure powered by HighLevel, Inc. (GoHighLevel) and its integrated telecommunication sub-providers (e.g., Twilio). By using our Services, you acknowledge the underlying infrastructure and agree to abide by the respective Acceptable Use Policies.

2. Account Registration and Responsibilities

To use our Services, you must register for an account and provide accurate, current, and complete information.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account or sub-accounts. You agree to notify us immediately at [email protected] of any unauthorized use of your account.

3. Acceptable Use of AI Voice and CRM Features

You agree to use the Platform and its Voice AI features strictly in compliance with all applicable local, national, and international laws, including the European General Data Protection Regulation (GDPR) and telecommunication regulations.

Mandatory Disclosure: Pursuant to our infrastructure policies, you are strictly required to disclose to your end-users and callers when they are interacting with an artificial intelligence-based voice or chatbot. You must implement appropriate privacy disclosures and legal legal bases on your local channels (e.g., telephone routing notices or website privacy policies).

You shall not use the Voice AI or SMS features to conduct unlawful spamming, cold-calling campaigns without prior explicit consent (opt-in), or any deceptive, harassing, or fraudulent practices.

4. Fees, Billing, and Re-Billing

Access to moneymagnet.ai is subject to the payment of subscription fees as specified in your selected plan or individual offer.

Usage-Based Charges (Re-Billing): Telephone minutes, AI processing units, and SMS carrier charges are billed dynamically based on actual consumption (Pay-as-you-go / Re-Billing via your Platform Wallet). You agree to maintain sufficient funds or a valid payment method to cover usage fees.

All fees are net fees exclusive of statutory value-added tax (VAT), if applicable.

Subscription cancellations must be submitted at least 7 days before the next billing cycle.

5. Limitation of Liability and Service Availability

We strive to provide maximum uptime and reliable AI text/voice processing. However, due to the nature of cloud software and telephone routing, we do not guarantee uninterrupted availability of the Services.

Limitation under Applicable Law (DACH Region): For clients operating in the EEA, Austria, and Germany, our liability for slight negligence (leichte Fahrlässigkeit) is excluded, except for personal injury or breaches of core contractual obligations (Kardinalpflichten).

We are not liable for any business interruptions, loss of revenue, or missed service appointments caused by technical malfunctions, latency, or incorrect data transcriptions generated by the AI system. The final validation of customer data remains the client's business responsibility.

6. Indemnification

You agree to indemnify, defend, and hold harmless moneymagnet.ai (Mag. Martin Parkos) from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees and regulatory fines) arising out of your violation of these Terms, your misuse of the Voice AI features, or your failure to provide proper GDPR-compliant notifications to your telephone callers.

7. Termination

We reserve the right to suspend or terminate your account and access to the Services immediately and without prior notice if you violate these Terms, breach third-party carrier policies, or fail to settle outstanding usage balances.

8. Governing Law and Jurisdiction

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Austria, excluding its conflict of law provisions.

The exclusive place of jurisdiction for all disputes arising from this contractual relationship is Wien (Vienna), Austria.
